Terms of Service
Last updated: [[EFFECTIVE DATE]]
These terms are the agreement between you and Booniverse Inc. ("Booniverse", "we", "us") for use of the Booniverse app. By creating an account you accept them. If you don't accept them, don't use Booniverse.
Please also read our Privacy Policy, Medical Disclaimer, Community Guidelines and Code of Conduct. They're part of this agreement.
1. Booniverse is not therapy or medical care
This is the most important thing in this document.
Booniverse offers peer support: other users, most of them young people, who volunteer to listen. They are not therapists, counsellors, doctors, nurses or crisis workers. They have completed a short in-app training module and nothing more. Nothing in Booniverse — including anything a listener says, anything the Moon reflection generates, or any Boo-Logy result — is medical advice, diagnosis or treatment.
If you are in danger or thinking about harming yourself, contact your local emergency services or a crisis line immediately. Booniverse is not an emergency service and nobody is guaranteed to be watching.
The full Medical Disclaimer sets this out in detail and you agreed to it when you signed up.
2. Who can use Booniverse
You must be 13 or older. If you're under the age of legal majority where you live, you confirm that you're allowed to use a service like this.
You need to give us a real email address, a username, and your date of birth. One account per person. Don't create an account for someone else, don't impersonate anyone, and don't sell or transfer your account.
[[LAWYER: EEA/UK 13–16 position — must match the Privacy Policy §1.]]
3. Your account
- Keep your password to yourself. You're responsible for what happens on your account.
- Tell us at support@booniverse.boo if you think someone else has access.
- You can change your username and email once every 90 days.
- We may need to verify your email address.
4. What you may not do
The Community Guidelines are the full list. The short version — do not:
- Bully, harass, threaten, stalk or hate on anyone.
- Post sexual content, or any sexual content involving minors under any circumstances. This is reported to the authorities.
- Encourage, glorify, instruct or coach anyone toward self-harm, disordered eating or suicide.
- Sell things, promote things, spam, or recruit people off the app.
- Ask another user for their address, school, phone number, or to meet up.
- Pretend to be a professional, or offer medical, clinical or legal advice.
- Share anyone's personal information, including screenshots of private chats.
- Try to break, scrape, reverse-engineer, overload or work around our security, our rate limits, or our moderation.
- Use Booniverse if we've previously banned you.
5. Your content
You keep ownership of everything you write and upload.
You give us a licence to store, display and transmit your content for the purpose of operating Booniverse — for example showing your forum post to other users, delivering your note to its recipient, or generating a Moon reflection. This licence ends when you delete the content or your account, except where we need to retain something for safety, legal or accounting reasons.
We don't use your content to train AI models.
You're responsible for what you post. Don't post things you don't have the right to post.
6. Moderation, suspension and banning
We check content automatically and we review reports. We can remove content, restrict features, suspend your account, or ban you permanently — including without warning where the situation is serious.
Strikes and suspensions are applied automatically when your content is flagged, and escalate with repeat behaviour. Serious violations — sexual content involving minors, credible threats, grooming — result in an immediate permanent ban.
Appeals. If you think we got it wrong, email support@booniverse.boo. Tell us your Boo ID and what happened. We'll review it and reply. [[LAWYER: commit to a response window. Apple 1.2 expects "timely responses"; the EU DSA may require a formal internal complaint-handling system — confirm whether it applies at your scale.]]
7. BOO, purchases and Boo+
- BOO is an in-app currency with no real-world value. It cannot be exchanged for money, transferred between accounts, or refunded once spent.
- BOO top-ups are consumable in-app purchases. Boo+ is an auto-renewing subscription.
- All purchases go through the Apple App Store or Google Play. They take the payment; we never see your card details. Their refund policies apply, and cancellations and refunds are handled by Apple or Google, not by us.
- Manage or cancel Boo+ in your App Store or Google Play account settings. Deleting the Booniverse app does not cancel a subscription.
- Prices and what BOO buys may change; we'll tell you before a change affects you.
- If your account is banned, unspent BOO and any remaining subscription time are forfeited.
[[LAWYER: confirm this is enforceable in your jurisdiction — consumer-protection rules in the EU/UK may not permit forfeiting paid-for subscription time, and this is a contract with minors.]]
[[LAWYER: statutory withdrawal/cooling-off rights for EU/UK consumers on digital content, and the fact that many users are minors contracting for paid services, both need proper treatment here.]]
8. Volunteering as a listener
If you complete the volunteer training you can take support requests from other users.
- You must be 18 or over. Listeners support teenagers, so we check your age on our servers before granting the role — not just in the app.
- The training is short and basic. It does not make you a counsellor and the certificate is not a professional qualification or credential.
- You must follow the Code of Conduct.
- Don't diagnose, don't prescribe, don't promise confidentiality you can't keep, don't take a conversation off Booniverse, and never arrange to meet someone.
- If someone tells you they're in danger, follow the in-app crisis prompts and end the conversation with the resources shown. You are not responsible for saving anyone, and you are never expected to handle an emergency alone.
- We can remove your listener status at any time.
9. Deleting your account
You can delete your account at any time from Profile → About → Delete Account.
Deletion removes your profile, journals, reflections, notes, anonymous posts, contacts, notifications, listener records, uploaded images and your sign-in. Forum posts, comments and chat messages are redacted — your name and content are removed, but the entry stays so other people's conversations and threads don't break. This can't be undone.
Some records are kept after deletion where we're required to, or for safety purposes — moderation and safety records, and purchase records we need for accounting. See the Privacy Policy for detail.
If your account is suspended or banned when you delete it, deleting does not lift the sanction — we retain a scrambled record of your email so it can still be enforced.
10. Our liability
`[[LAWYER — DRAFT THIS PROPERLY. This is the clause that matters most and the one a generator will get wrong. It has to address, at minimum:
(a) that support is provided by untrained volunteer peers, not us; (b) that we don't monitor every conversation in real time and don't guarantee any particular response, response time, or that anyone is available; (c) harm arising between users, including off-platform contact; (d) failure of the automated moderation to catch something; (e) reliance on AI-generated reflections; (f) the statutory limits — you cannot exclude liability for death or personal injury caused by negligence in most jurisdictions, and many of your users are minors, which affects what an exclusion clause can do; (g) the interaction with App Store / Play consumer terms.
Do not paste a standard SaaS limitation-of-liability clause here. This is the single strongest argument for paying a lawyer for a few hours.]]`
11. Changes to these terms
We may update these terms. If a change is significant we'll notify you in the app and ask you to accept the new version before continuing. Your agreement is recorded against a version number.
12. General
- Booniverse Inc. is incorporated in the State of Delaware, USA, with its principal place of business in New York, NY.
- Governing law:
[[LAWYER — two defensible options: Delaware (state of incorporation) or New York (principal place of business). This is a real choice, not a formality: it decides which consumer-protection statutes apply to a contract that many users enter as MINORS, and New York and Delaware differ on the enforceability of terms against them.]] - Disputes:
[[LAWYER — venue, and whether to include an arbitration clause and class-action waiver. Note these are frequently unenforceable against minors and draw regulatory attention in consumer apps; do not paste a standard SaaS clause here.]] - If part of these terms is unenforceable, the rest still applies.
- These terms, plus the documents linked at the top, are the whole agreement.
